Il «diritto liturgico»: significato e intepretazioni
«Diritto liturgico» è una formula controversa. C’è chi la usa senza problemi e chi la considera inadeguata. L’A. compie una ricerca sull’uso della formula prima e dopo il Vaticano II. Per il prima, la formula veicola il concetto di liturgia allora dominante, condannato nella Mediator Dei. Per il dopo, gli autori assumono la descrizione contenuta in Sacrosanctum Concilium n. 7 e considerano la disciplina liturgica come una componente intrinseca alla liturgia stessa. Le concezioni di liturgia e di diritto si rivelano fondamentali per l’esame della questione sulla mancata realizzazione di un auspicato «codice di diritto liturgico». Nell’ultima parte l’A. offre una serie di riflessioni fondative del «diritto liturgico», inteso nel senso del can. 2 del Codice di diritto canonico. Non mancano gli spunti per una verifica sulla situazione del «diritto liturgico» nell’attuale momento storico.
«Liturgical Law» is a controversial expression. Somebody uses it without problems and there are people who consider it inadequate. The A. investigates how this expression has been used before and after Vatican II. As for the time before it, this expression transmits the liturgy’s conception that was prevailing at that time and was condemned by Mediator Dei. After Vatican II, the scholars assume the description of liturgy as it is contained in Sacrosanctum Concilium 7 and consider Liturgical norms as an intrinsic component of liturgy itself. The conceptions of liturgy and Canon Law are seen as fundamental in order to discuss the question about the failed achievement of an hoped «Code of Liturgical Law». The last part of this article offers a series of considerations that aim to provide foundations to the «Liturgical Law», as it is understood in can. 2 of Code of Canon Law. There are also some hints that help to verify the situation of the «Liturgical Law» in the present historical time.
